Well I am kind of thinking at least there should be a third choice and that would be Smith at the least gets second. He got robbed BIG TIME!!
Huge Bad Call by Nascar!!!!!!

Im still sticking with my decision about stewart winning...although I dont see why they did move Smith back to 18th! penalty is u give the posision back...not take 18 spots away! Not sure at all why they did that, but the win should have, and did go to tony.

Stewart did not win the race. it goes to smith. funny how kyle busch gets the win after doing the same move, and Jonny benson passes below the yellow line to finish second, but no penalties to those guys. Its just nascar playing favorites with toyota
From the replays I saw, Smith did have a nose under Stewart when Stewart threw that block. I thought it was pretty conclusive that Smith was forced down under the line. If Smith doesn't go below the line, he takes out Stewart and a bunch of other cars and possibly himself as well.

As I've said on youtube and here a few times the lesson is next time wreck the guy because hey at least if you wreck in finish bad its not because of a stupid call.
yep nascar needs to look at his front fender and see all the yellow and green paint on it..he got forced... and gordonfan... to explain it, they said not giving the position back... would have been a pass thru penalty, which would have put the 01 to the tail of the lead lap... sux but at least they gave reason for this, guess he learned a valuable lesson.. vickers wiped out JJ and JR a few yrs ago and that is ok, guess next time he will wreck tony and then na$car will be the ones ultimately to blame if their main players all end up hurt or dead....

But how could he have given the position back? It happened right at the finish line when he made the pass below the line so he had no room to give it back.
its funny...this is being discussed everywhere! The nascar commentaters even have diff opinions on it.

exactly... so they are issuing the penalty with out the three lap black flag... I think he should appeal the finish, but I doubt it will get him anywhere, na$car will NEVER admit to being wrong......

Below yellow line at Daytona/Talladega OK on last lap? NO: This was posted back in Feb 2007 about the Truck Series race at Daytona. The 'rule' was metnioned at the end of ABC's broadcast, but NASCAR ruled otherwise.
Drivers throughout the Craftsman Truck Series garage were still talking about last week's [Feb 2007] three-wide finish at Daytona International Speedway. While they admitted the finish was good for television, most wondered why NASCAR allowed Johnny Benson to drive below the yellow line - Daytona's out of bounds line - to jump from third to second in the final 200 yards. Benson wasn't penalized because "if you can see the checkered flag on the last lap, anything goes," according to NASCAR spokesman Owen Kearns.(Augusta Chronicle)(2-24-2007/10-5-2008), no word on the exact ruling, problems with the ruling? take it up with NASCAR, contact info on my Racing FAQ/Contact NASCAR page.
from NASCAR: Post-Race Comments from NASCAR Vice President of Corporate Communications Jim Hunter Talladega Superspeedway, Oct. 5, "You cannot improve your position anytime you go below the yellow line. In our judgment, he (Regan Smith) improved his position and the penalty for that is a pass thru, so he was moved back to the tail end of the longest line or 18th position. At the driver's meeting, we clearly state that you cannot improve your position by going below the yellow line. We do not feel he was forced below the yellow line. Anytime you get into a situation like this, there are going to be two different opinions. We respect Regan's view, but we made the call, we think it's the right call and the finish is final. NASCAR has to maintain some kind of control – and that's the reason we say, you cannot advance your position by going below the yellow line. If he had not improved his position, he probably would have been awarded 2nd place."(NASCAR)(10-5-2008)
