I didn't completely copy you because I figure he won't finish 43rd because he will find a way to get 42nd and hes got to finish in the top 3 since he seems to do it for all the other races. Also kinda trying this for a jinx which I figure won't work, but is worth a try.

Um it is just like any other pick. He can only get 1 place right and the pole. How is that a foul?? Kyle isn't good enough to place 1st, 2nd, and 3rd lol
It kind of hinders the player from getting more than one guess right too.

yep...i picked him 1st...2nd...3rd...and 43rd...their are still 39 other spots he could finish. So if u calculate it...i only got a 9.3% chance of getting points.
